Website, Public Course, Virtual Training and Corporate Training Terms

Training Creatively is a trading brand of Creative Consulting and Training Ltd, a company registered in England and Wales (Company No. 07614266). These Terms and Conditions govern the use of our website, products, services, training courses, examinations, events and related services.

1. Definitions

  • “Company”, “we”, “our” or “us” refers to Creative Consulting and Training Ltd trading as Training Creatively.
  • “Client” refers to any organisation purchasing services from us.
  • “Delegate”, “you” or “your” refers to an individual attending or purchasing a course or service.
  • “Services” refers to training courses, workshops, exams, consultancy, coaching, eLearning, webinars and related services.

2. Acceptance of Terms

  • By accessing our website, booking a course, purchasing services or attending any training event, you agree to be bound by these Terms and Conditions.
  • If you are booking on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

. Booking and Payment Terms

  • All bookings are subject to acceptance and availability.
  • Invoices must be paid by the due date stated on the invoice unless otherwise agreed in writing.
  • For corporate bookings, agreed payment milestones and purchase order requirements shall apply.
  • We reserve the right to refuse attendance or suspend services where payments remain outstanding.
  • Interest may be charged on overdue commercial invoices in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.

4. Cancellation and Refund Policy

  • Delegates may cancel public course bookings by written email notice.
  • Cancellations made 28 days or more before the course start date will receive a full refund less any non-refundable exam or administrative fees.
  • Cancellations made between 14 and 27 days before the course start date will receive a 50% refund.
  • Cancellations made less than 14 days before the course start date are non-refundable.
  • Substitute delegates may attend at no additional cost, subject to eligibility requirements.
  • Where a course is postponed or cancelled by us, delegates may transfer to another date, attend virtually where applicable, or request a refund.
  • Refunds approved in writing will normally be processed within 28 working days.

5. Corporate Training

  • Corporate engagements may also be governed by separate proposals, statements of work or master service agreements.
  • Where separate corporate agreements exist, those agreements shall take precedence over these Terms in the event of conflict.

6. Delegate Responsibilities

  • Delegates are responsible for ensuring they meet course prerequisites where applicable.
  • Delegates attending virtual or online exams must ensure they have suitable internet access, hardware, webcam functionality and system permissions.
  • Delegates must behave professionally and respectfully towards trainers, staff and other participants.
  • We reserve the right to remove any delegate whose conduct is disruptive, abusive, discriminatory or inappropriate without refund.

7. Accessibility and Reasonable Adjustments

  • We are committed to supporting accessibility and inclusion in accordance with the Equality Act 2010.
  • Delegates requiring reasonable adjustments or additional support should notify us as early as possible before the course or examination.

8. Intellectual Property

  • All course materials, presentations, recordings, templates, methodologies and content remain the intellectual property of the Company or its licensors.
  • Materials may not be copied, redistributed, reproduced, published, uploaded, shared or commercially exploited without prior written consent.
  • Delegates may use training materials solely for their own personal or internal organisational learning purposes.

9. Virtual Learning and Recording

  • Certain virtual sessions may be recorded for quality assurance, delegate support or compliance purposes.
  • Delegates are not permitted to record training sessions without prior written permission.
  • Access to online learning platforms may be time-limited in accordance with the terms of the course purchased.

10. Data Protection and Privacy

  • We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
  • Our Privacy Statement explains how we collect, store and process personal data.
  • We will not sell personal data to third parties.
  • Delegates consent to receiving operational communications relevant to booked services.

11. Complaints Procedure

  • Complaints should be submitted in writing to complaints@trainingcreatively.com.
  • We will acknowledge complaints within two working days.
  • We aim to investigate and provide a resolution response within ten working days.
  • Where additional investigation is required, we will keep the complainant informed of progress.

12. Limitation of Liability

  • Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot legally be excluded.
  • Subject to applicable law, our total liability relating to any service shall not exceed the fees paid for that specific service.
  • We shall not be liable for indirect, consequential or business losses including loss of profits, contracts, goodwill or data.

13. Force Majeure

  • We shall not be liable for delays or failure to perform obligations due to events outside our reasonable control, including but not limited to natural disasters, strikes, internet outages, pandemics, terrorism, civil unrest or government restrictions.

14. Website Usage

  • Website content is provided for general information purposes only.
  • Unauthorised use of this website or its content may give rise to legal claims.
  • We do not guarantee uninterrupted or error-free website availability.

15. Links to Third-Party Websites

  • Our website may contain links to external websites. We are not responsible for the content, security or privacy practices of third-party sites.

16. Marketing Communications

  • Where legally permitted, we may send information relating to courses, events, services and professional development opportunities.
  • Recipients may opt out of marketing communications at any time.

17. Governing Law

  • These Terms and Conditions are governed by the laws of England and Wales.
  • The courts of England and Wales shall have exclusive jurisdiction over disputes arising under these Terms.

Course availability is confirmed when you have received a course confirmation email containing your joining Information and once payment has been authorised and collected. By booking any of the courses in this website, delegates accept that the liability of any claim against Creative Consulting and Training Ltd is limited to the amount actually paid for the course they booked in the event of any successful claim. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
